kya hai soochana ka adhikar (RTI)
soochana ka adhikar adhiniyam (Right to Information Act/RTI) bharat ki snsad dvara parit ek qanoon hai, jo 12 aktoobar 2005 ko lagoo hua (15 joon, 2005 ko isake qanoon banane ke 120 ven din). bharat men bhratachar ko rokane aur samapt karane ke liye ise bahut hi prabhavi qadam bataya jata hai. yah qanoon bharat ke sabhi nagarikon ko sarakari phailon/rikaaudarhs men darj soochana ko dekhane aur use prapt karane ka adhikar deta hai. jammoo evn kashmir ko chhod kar bharat ke sabhi bhagon men yah adhiniyam lagoo hai. sarakar ke snchalan aur adhikariyon/karmachariyon ke vetan ke mad men kharch hone vali rakam ka prabndh bhi hamare-apake dvara die ge karon se hi kiya jata hai. yahan tak ki ek riksha chalane vala bhi jab bazar se kuchh kharidata hai to vah bikri kar, utpad shulk ityadi ke roop men taiks deta hai. isalie ham sabhi ko yah janane ka adhikar hai ki us dhan ko kis prakar kharch kiya ja raha hai. yah hamare maulik adhikaron ka ek hissa hai.
kisase aur kya soochana mang sakate hain
sabhi ikaiyon/vibhagon, jo snvidhan ya any qanoonon ya kisi sarakari adhisoochana ke adhin bane hain athava sarakar dvara niyntrit ya vittaposhit kie jate hon, vahan se snbndhit soochana mangi ja sakati hai. sarakar se koee bhi soochana mang sakate hain. sarakari nirnay ki prati le sakate hain. sarakari dastavejon ka nirikshan kar sakate hain. sarakari kary ka nirikshan kar sakate hain. sarakari kary ke padarthon ke namoone le sakate hain.
kisase milegi soochana
is qanoon ke tahat pratyek sarakari vibhag (kendr sarakar, rajy sarakar v sthaniy prashasan ke har karyalay) men jan/lok soochana adhikari (piaeeo - PIO) ke pad ka pravadhan hai. lok soochana adhikari ki zimmedari hai ki vah janata ko soochana upalabdh karaen evn avedan likhane men usaki madad karen. aratiaee avedan inake pas jama karana hota hai. avedan patr jama karane ki pavati jarur len. isake alava kee adhikariyon ko sahayak jan soochana adhikari ke pad par niyukt kiya jata hai. unaka kary janata se aratiaee avedan lena aur piaeeo ke pas bhejana hai.
yadi piaeeo ya epiaeeo ka pata lagane men kathinaee hoti hai to ap avedan vibhagadhyaksh ko bhej sakate hain. vibhagadhyaksh ko vah arji snbndhit piaeeo ke pas bhejani hogi.
aratiaee avedan kahan jama karen
ap apana aratiaee avedan (jisamen apaki samasya se jude saval honge) snbndhit sarakari vibhag ke lok soochana adhikari (piaeeo) ya epiaeeo ke pas svayn ja kar ya dak ke dvara jama kara sakate hain. kendr sarakar ke vibhagon ke mamalon men 629 dakagharon ko epiaeeo banaya gaya hai. matalab yah ki ap in dakagharon men se kisi ek men jakar aratiaee kauntar par apana aratiaee avedan aur shulk jama kara sakate hain. vahan apako ek rasid bhi milegi. yah us dakaghar ka uttaradayitv hai ki vah use snbndhit piaeeo ke pas bheje.
aratiaee qanoon ke mutabiq pratyek sarakari vibhag men ek lok soochana adhikari ko niyukt karana avashyak hai. yah zaroori nahin hai ki apako us piaeeo ka nam maloom ho. aur han ek bachcha bhi aratiaee qanoon ke tahat aratiaee avedan dakhil kar sakata hai.
kitana avedan shulk
avedan patr ke sath nirdharit phis dena jaruri hai. pratilipi/namoona ityadi ke rup me soochana pane ke lie nirdharit shulk dena jaruri hai. avedan ke sath kendr sarakar ke vibhagon ke lie 10 rupaye ka avedan shulk dena padata hai. halanki vibhinn rajyon men alag-alag shulk nirdharit hain. kahin avedan ke lie shulk 10 rupaye hai to kahin 50 rupaye. soochana pane ke lie 2 rupaye prati soochana prishth kendr sarakar ke vibhagon ke lie dene padate hain. yah shulk vibhinn rajyon ke lie alag-alag hai. kahin soochana pane ke lie shulk 2 rupaye hai to kahin 5 rupaye. avedan shulk nakad, baink didi, bainkar chek ya postal ardar ke madhyam se jama kiya ja sakata hai. kuchh rajyon men ap kort phis tikaten kharid sakate hain aur apani arzi par chipaka sakate hain. aisa karane par apaka shulk jama mana jaega. ap tab apani arzi svayn ya dak se jama kara sakate hain. garibi rekha se niche rahane valon ko koee shulk nahin dena padata hain.
avedan ka praroop kya ho
kendr sarakar ke vibhagon ke lie koee nirdharit praroop nahin hai. ap ek sade kagaz par ek samany arzi ki tarah hi avedan bana sakate hain aur ise piaeeo ke pas svayn ya dak dvara jama kar sakate hain. (apane avedan ki ek prati apane pas niji sndarbh ke lie avashy rakhen).
avedan ka praroop - lok soochana adhikari, vibhag ka nam evn pata. avedak ka nam evn pata. chahi gee janakari ka vishay. chahi gee janakari ki avadhi. chahi gee janakari ka sampoohrn vivaran. janakari kaise prapt karana chahenge- pratilipi/namoona/likhit/nirikshan. garibi rekha ke niche ane vale avedak saboot lagaen. avedan shulk ka vyaura-nakad, baink drapht, bainkars chaik ya postal aaudar. avedak ke hastakshar, dinank.
soochana ke lie karan batana jaroori nahi
koee karan ya any soochana keval snpark vivaran (nam, pata, phon nnbar) ke atirikt dene ki zaroorat nahin hai. soochana qanoon spashtatah kahata hai ki prarthi se snpark vivaran ke atirikt kuchh nahin poochha jaega.

piaeeo ko avedan dene ke 30 dinon ke bhitar soochana mil jani chahie. yadi avedan sahayak piaeeo ko diya gaya hai to soochana 35 dinon ke bhitar mil jani chahie.

dvitiy apil kya hai
dvitiy apil aratiaee adhiniyam ke tahat soochana prapt karane ka antim vikalp hai. dvitiy apil 'soochana ayog' ke pas dayar ki ja sakati hai. kendr sarakar ke vibhagon ke viruddh kendriy soochana ayog (siaeesi) hai aur rajy sarakar ke vibhagon ke viruddh rajy soochana ayog. pratham apil ke nishpadan ke 90 dinon ke bhitar ya us tarikh ke 90 dinon ke bhitar ki jab tak pratham apil nishpadit honi thi, dvitiy apil dayar ki ja sakati hai. agar rajy soochana ayog men jane par bhi soochana nahin mile to ek aur smaranapatr rajy soochana ayog men bhej sakate hain. yadi phir bhi koee karravaee nahin hoti hai to ap is mamale ko lekar haeekort ja sakate hain.
piaeeo dvara avedan n lene aur soochana na dene par saja
yadi piaeeo ya snbndhit vibhag aratiaee avedan svikar n karen aisi sthiti men ap apana avedan dak dvara bhej sakate hain. isaki aupacharik shiqayat snbndhit soochana ayog ko bhi anuchchhed 18 ke tahat karen. piaeeo aratiaee avedan lene se kisi bhi paristhiti men mana nahin kar sakata. bhale hi vah soochana usake vibhag/karyakshetr men n ati ho. use arji svikar karani hogi. yadi avedan-arji us piaeeo se snbndhit n ho to vah use upayukt piaeeo ke pas panch dinon ke bhitar anuchchhed 6 (3) ke tahat bhej sakata hai.
lok soochana adhikari avedan lene se inkar karata hai, soochana dene se mana karata hai ya janabujhakar galat soochana deta hai to us par pratidin ru. 250 ke hisab se soochana ayukt dvara jurmana lagaya ja sakata hai v kul ru. 25,000 tak ka jurmana lagaya ja sakata hai. yah jurmana us adhikari ke niji vetan se kata jata hai. piaeeo par lage jurmane ki rashi avedak ko nahin di jati hai, jurmane ki rashi sarakari khazane men jama ho jati hai. halanki anuchchhed 19 ke tahat, avedak muavaza mang sakata hai.

yadi sarakar un adhikariyon ke nam v pad batati hai, to unaka uttaradayitv nirdharit ho jata hai. ek adhikari apane viruddh is prakar koee uttaradayitv nirdharit hone ke prati ka़phi satark hota hai. is prakar, jab koee is tarah apani arji deta hai, usaka ruka kary snpann ho jata hai.
aaunalain karen apil ya shikayat

dilli ki ek snstha pisiareph ne 2009 men ek avard ki shuruat ki. maqasad tha un logon ki hausala aphajaee aur samman, jinhonne apani jan ki bazi lagakar bhrashtachar ke khila़ph halla bola, jinhonne soochana qanoon ka istemal karake sarakari vyavastha men vyapt bhrashtachar ko ujagar kiya. sach aur eemanadari se kam karane vale kee aratiaee karyakarta ko isaki qimat apani jan gnvakar chukani padi. un sabhi desh bhakt logo ko ham sab ka salam !!!!!
